Levi B. Krebs and Cristen M. Krebs have filed a lawsuit against Dominic J. Cercone, M.D., Elizabeth Kennedy Hewett Brumberg, M.D., UPMC Children's Hospital of Pittsburgh, University of Pittsburgh Physicians, Michael E. Petrosky, M.D., and Allegheny Clinic d/b/a AHN Pediatrics in the Court of Common Pleas of Allegheny County, Pennsylvania (Case No. GD-24-). The complaint was filed on May 13, 2024.

The plaintiffs allege that Levi Krebs received negligent medical care from the defendants between August 29 and 31, 2023, which led to severe complications from bacterial meningitis. Represented by attorneys Patrick K. Cavanaugh, Zachary N. Gordon, and Hugh T. McKeegan from Del Sole Cavanaugh Stroyd LLC, the plaintiffs claim that Levi's condition worsened due to failure in proper diagnosis and timely treatment.

Levi suffered significant injuries including multiple strokes, cranial nerve palsy causing double vision requiring an eye patch, left-hand tremor, migraine headaches with auras due to brain scarring, and occlusion of his internal carotid arteries. These injuries have resulted in substantial medical expenses and loss of academic time.

The plaintiffs seek judgment against the defendants for professional negligence and negligent infliction of emotional distress for damages exceeding the court's arbitration limits. They demand compensation for pain and suffering, disfigurement, lost earnings, future medical treatments including potential surgeries.
