Tenant Sues Property Management Companies Over Negligence Leading To Severe Injuries

A dangerous sidewalk condition at a Pennsylvania apartment complex has led to a lawsuit that could have significant implications for property management companies. Marsha L. Vasaturo filed the complaint in the Court of Common Pleas of Delaware County on June 26, 2024, against Drexelbrook 2019 LLC and AJH Management Limited Liability Company.

According to the court documents, Vasaturo alleges that she sustained severe injuries due to a hazardous condition on the walkways and sidewalks of Drexelbrook Apartments in Drexel Hill, Pennsylvania. The complaint states that the defendants were responsible for maintaining these areas and failed to address a section of walkway dangerously elevated by at least one inch above the adjoining sidewalk. This uneven surface caused Vasaturo to trip and fall on April 16, 2023, resulting in multiple injuries including facial lacerations, fractures in her right arm, and severe bruising.

Vasaturo's attorney, Paul Fellman from Gibson & Perkins P.C., asserts that the defendants had ample time to identify and rectify this dangerous condition but neglected their duty. "Defendants knew or should have known about the hazard," Fellman stated in the filing. He further accuses Drexelbrook 2019 LLC and AJH Management Limited Liability Company of failing to provide adequate warnings or take necessary precautions such as erecting barricades or posting warning signs around the uneven sidewalk area.

The plaintiff is seeking judgment against both defendants for an amount exceeding $50,000 along with pre- and post-judgment interest. The lawsuit claims negligence on multiple fronts: failure to maintain safe walkways, inadequate inspection procedures, lack of timely repairs despite awareness of the hazard, and insufficient warnings to pedestrians about potential dangers.

In addition to financial compensation for medical expenses incurred due to her injuries, Vasaturo is also claiming damages for pain and suffering as well as loss of ability to perform daily activities. The lawsuit underscores that these injuries have led to significant financial detriment and loss for Vasaturo.

The case will be presided over by judges from the Court of Common Pleas of Delaware County. Attorney Paul Fellman represents Marsha L. Vasaturo.
