PITTSBURGH – A Penn State University student who suffered a series of full-body injuries, including a lacerated spleen, after falling out of his residence’s window during a hallway race with his friends, has sued the property’s managers for negligence, arguing they didn’t test the window’s strength and safety.

Sean O'Rourke filed a complaint in the Court of Common Pleas of Allegheny County against Lowe's Home Centers LLC doing business as Lowe's alleging negligence. O'Rourke was at the Lowe's store on Baptist Road in Bethel Park on Aug. 7, 2020.
