PHILADELPHIA – Legal action has been filed by a Philadelphia woman who claims an ambulance company’s personnel tasked with aiding her father in a medical emergency, instead caused him injury which led to his death.
Cindia Bost, Administrator of the Estate of James Ryals [deceased], of Philadelphia filed suit in the Philadelphia County Court of Common Pleas on June 20 against Rhythm Ambulance, Inc., of Bensalem.
“On or about Nov. 25, 2015, plaintiff’s decedent was being transported by defendant’s agent, servant, workman, or employee when defendant’s employee’s carelessness and negligence caused the plaintiff to fall and strike his head and cause serious and fatal personal injuries, on account of which this action is brought,” the complaint says.
“On or about Aug. 29, 2016, plaintiff, [Cindia] Bost, was appointed the Administrator of the Estate of James Ryals, decedent, by the Register of Probate and Wills and Grant of Letters Testamentary and of Administration, in and for the County of Philadelphia,” the complaint adds.
Per the lawsuit, Bost invoked Pennsylvania’s Wrongful Death and Survival Action to recover damages incurred due to the aforementioned events.
For counts of negligence, wrongful death and survival, the plaintiff is seeking damages in excess of $50,000, plus costs and other relief the Court deems necessary in this matter.
The plaintiff is represented by Marc I. Simon of Simon & Simon, in Philadelphia.
